1. Introduction

These Terms of Service ("Terms") govern your access to and use of the LlamaPen API service (the "Service") provided at https://llamapen.app/ and https://api.llamapen.app/ ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

For information on privacy and data handling, a privacy policy is available at https://api.llamapen.app/privacy.

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you confirm that you meet this requirement. If you are accessing the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account registration

To access certain features of the Service, you must sign in using your Google account. You are responsible for maintaining the confidentiality of your account and any activity under it. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Use of the service

You agree to not misuse the Service or help others to do so. This includes but is not limited to:

• Accessing or using the Service in violation of any applicable law
• Attempting to reverse-engineer or tamper with the Service
• Using automated systems to overload or disrupt the API
• Sharing your account with others

By using the chat features of the Service, you acknowledge that messages you send will be forwarded to a third-party AI provider (OpenRouter) for response generation. Please refer to Section 10 for disclaimers regarding AI-generated content.

5. Subscriptions and billing

Some features of the Service are only available via a paid subscription. Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method for the applicable fee. You may cancel at any time, and your subscription will remain active until the end of the billing period. If you encounter any issues with billing, you can contact us at support@llamapen.app

6. Usage

If you access the Service, you agree to comply with any usage quotas, daily message/token limits, or rate restrictions associated with your account tier. Excessive or abusive use of the Service may result in throttling, temporary suspension, or termination.

7. Termination

In some cases, we may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms or pose a risk to the security or integrity of the Service.

You may terminate your account at any time by contacting us or by interaction in the UI. Upon termination, you will lose access to the Service and your data may be deleted as described in our Privacy Policy.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of its owners. Your use of the Service does not grant you ownership of any intellectual property rights in the Service or its content.

9. User Content

You retain ownership of any content you submit through the Service. By submitting content through the Service, you grant us a non-exclusive, worldwide license to use, host, and process that content solely for the purpose of operating the Service. You are responsible for ensuring your content does not violate any laws or infringe third-party rights.

10. AI-Generated Content Disclaimer

The responses generated by the Service are provided by third-party AI models via OpenRouter. These responses are generated automatically based on user input and are not reviewed or moderated by us before being returned to you

By using the chat features of the Service, you understand and agree that the content of your messages will be sent to a third-party provider, OpenRouter, for the purpose of generating AI responses. You agree not to include any sensitive personal information or confidential data in your messages.

The AI-generated responses are provided as-is and may include incorrect, misleading, or offensive content. You are solely responsible for how you use or interpret the output.

We do not control or moderate the content generated in response to your chat messages. The generated responses are produced by third-party AI systems and are returned directly to you. Use discretion and avoid relying on generated outputs for critical or sensitive decisions.

You understand and agree that:

• The content may be inaccurate, misleading, offensive, or otherwise inappropriate.
• We make no guarantees regarding the accuracy, legality, or usefulness of any generated output.
• You use the outputs at your own risk, and we are not liable for any loss, harm, or damages resulting from your reliance on AI-generated content.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
